Dassel Man Charged in Hutchinson Police Officer Involved Shooting 11 Feb 14

A Dassel man has been charged and a complaint summons was signed Monday (Feb 10th) against him for his involvement in a police officer involved shooting that occurred at an apartment in Hutchinson in October of last year (2013).

Twenty-four-year-old Justin Thomas Delare is charged with one felony count of attempting to disarm a peace officer.

The shooting took place at 8:30 a.m. on October 25th when Sgt. Eric Kilian responded to 455 High Street North East in Hutchinson following a 9-1-1 call of a suspicious person inside the multi-unit residence.

During a confrontation, Delare suffered a single gunshot wound to the abdomen and was taken to HCMC for treatment.

Sergeant Kilian was not injured and ultimately returned to work after the standard administrative leave and investigation by the Bureau of Criminal Apprehension and review though the McLeod County Attorney’s Office.

The BCA completed its investigation into whether Sgt. Kilian’s actions were appropriate and presented their findings to McLeod County Attorney Mike Junge for review of possible charges against Sgt. Kilian.  After his review, Junge declined to press any charges against Sgt. Kilian.

The Hutchinson Police Department then conducted their own investigation, and requested charges be filed against Delare.
